These terms and conditions govern the commercial contractual relationship between consumers who access our platform virtually, especially the access, use, registration and carrying out of commercial transactions on the products and services offered by IQOVE within or through the portal www.iqove.com, and the mobile applications that it manages.



Any person who registers on our website and/or makes a commercial transaction on it declares that they know and accept each and every one of the provisions established in our policies published on the website. Consequently, all acts and contracts entered into through our portal will be subject to the guidelines contained therein and to the current and applicable Colombian legislation.



IQOVE, through its website, displays various consumer products for advertising purposes, serving as a reference for consumers; it also displays various service packages and allows the use of its payment platform.



The contractual relationship between IQOVE and consumers is established with those who are located within the national territory, or who, while abroad, request the management of an order that must be carried out in Colombian territory, paying an economic consideration through the electronic payment system via the ______________________. platform.

Customer consent is manifested by completing and accepting each step of the purchase process on our website, and is finalized with the final purchase confirmation after reviewing the order summary, which details each product, its individual price, shipping costs (if applicable), other applicable charges, and the total amount the customer must pay. When placing the order, IQOVE will validate the transaction, payment methods, inventory availability, and personal data, among other things. Only if the order is accepted will IQOVE issue and send the order confirmation to the email address provided by the customer at the time of purchase.



Access to our website is made by the consumer as a capable person, declaring that, for the execution of purchase and sale contracts and the provision of services, they have full legal capacity to be a subject of rights and obligations, qualities that they validate with their registration. In no case will we be liable for direct or indirect damages suffered by the consumer due to the use or inability to use the platform.



The use of bank cards accepted on the website is subject to the contract existing between the client and the issuing bank, with IQOVE having no responsibility or involvement whatsoever. Any claim relating to the use and payment via bank cards must be made directly to the indicated third party.



IQOVE will make its best effort to ensure that – as far as possible – the website operates continuously and without errors. However, since it operates on the internet, this guarantee cannot be absolute. Therefore, IQOVE does not guarantee error-free and uninterrupted operation and will not be obligated to fulfill purchase orders generated based on malfunctions or errors. The client declares that they understand that this type of operation may present such situations.



IQOVE reserves the right to update the content whenever it deems appropriate, as well as to delete, limit, or prevent access to it temporarily or permanently, and to deny access to the website to consumers who misuse the content and/or violate any of our policies.



INTELLECTUAL PROPERTY

IQOVE holds all rights to the content, design, layout, and source code of this website and, in particular, to the photographs, images, logos, clothing designs, trademarks, and trade names included on the website. Therefore, they are legitimately used by IQOVE, either because they are its property, because it has authorization to make them available, or because it is authorized to do so by virtue of Andean Community Decisions 351 of 1993 and 486 of 2000 and Law 23 of 1982.



The intellectual property rights to the website and all content published on it are the exclusive property of IQOVE or have been licensed by its partners. The reproduction, adaptation, distribution, copying, alteration, modification, disclosure, total or partial reuse, commercialization, public communication and/or any other action that constitutes an infringement of Colombian or foreign law regarding intellectual and/or industrial property is expressly prohibited without the prior express written authorization of IQOVE.



IQOVE informs that it does not grant any implicit license or authorization regarding intellectual and/or industrial property rights or any other right or property related directly or indirectly to the content on the website.



E-COMMERCE

Based on Colombian provisions regarding data messages, according to Law 527 of 1999, national legislation recognizes the validity of data messages, and therefore, they acquire evidentiary character and standing. Consequently, consumers understand that, through the exchange of data messages, the parties involved can give rise to the creation, modification, and extinction of obligations, with the content, consequences, and effects of the generated information being their sole responsibility.



The commercial transaction that arises through this means is the conclusion of a sales contract by electronic means; at no time is a different contractual relationship established, such as supply, distribution, or similar.



E-COMMERCE SECURITY

Making payments through the IQOVE website is secure because it has maximum security measures in place. Therefore, www.iqove.com does not capture, store, or transmit transactional data, as it uses payment gateways: EPayco (credit card, debit card, and Efecty), certified with PCI; a certificate in high security standards that includes, among others, encryption software, validation procedures, and robust data protection measures.



PURCHASE CONDITIONS

PRODUCT AVAILABILITY: IQOVE informs that the units available on the website correspond to those existing in the warehouse. Under no circumstances will more units than available be intentionally put on sale.

In cases such as human error or difficulties in computer systems, where the quantity in available inventory differs from the order placed, IQOVE will inform the customer via email or WhatsApp of the total or partial cancellation of their order, so that they can select new products, or if the customer requests a refund, it will be processed according to the terms stipulated in the return policy.

PRICES
All product prices published on the website are expressed in Colombian pesos and correspond to the unit price of each product, including VAT and any other applicable taxes. They do not include additional shipping costs or any other additional expenses.

Additional costs, such as shipping (detailed in "Shipping Method") incurred due to the purchase, will be indicated and informed in the order, prior to its acceptance.

Website prices
The prices of the products displayed on the website will only be valid and applicable in this format. Consequently, IQOVE has full autonomy to modify its prices according to market needs, inventory rotation, special events or promotions without the need to notify the customer of these changes, except in the display of prices.

Typographical errors
IQOVE markets its products through a portal that is defined as a technological platform; therefore, it is possible that incorrect prices may appear due to system errors or typographical errors. The client declares that they understand and accept that, should this occur, IQOVE will inform them of the circumstance and may cancel the purchase order(s) containing the product(s) with the incorrect price, proceeding to refund the money for this reason.

PAYMENTS
Payment will be made through Mercado Pago's online platform. The customer agrees to pay at the time of ordering, for the clothing plus shipping costs. These amounts will be shown to the customer before completing the purchase. Payments are made through EPayco and, in the case of cash on delivery, through Servientrega or Coordinadora Mercantil SA. Customers can use VISA, MasterCard, American Express, and Diners Club credit cards, debit cards via PSE, pay in cash at Efecty, or cash on delivery.

When an electronic transaction (NOT applicable to cash on delivery) is rejected, the customer may contact their bank directly to verify the reason for the rejection. All transactions will be subject to verification of the effective receipt of funds in IQOVE's bank account and additional verifications.

IQOVE reserves the right to perform data validations through Mercado Pago to verify the correct identity of the cardholder in order to prevent impersonation or fraud. The order will not be shipped until this information is received.

APPLICABLE LEGISLATION

The legal system of the Republic of Colombia shall apply to any legal rule to which it is applicable.
